Terms and conditions

§ 1. GENERAL PROVISIONS

1. The website http://warta.test/ aims to promote Fundacja Warta Uwagi by informing Users about its activities.
2. These Terms and Conditions define the rules of using the website http://warta.test/, the type and scope of services provided electronically, as well as the conditions for concluding and terminating agreements. The content of the Terms is available at http://warta.test/regulamin/.
3. The Terms are provided free of charge to the User.
4. The User may use the website without registration.
5. The User is obliged to comply with the Terms of the website.
6. The User is required to read the Terms and the Privacy Policy.
7. Use of the website is equivalent to acceptance of these Terms.

§ 2. DEFINITIONS

Capitalized terms used in this document shall have the following meaning:

• Personal Data – information relating to an identified or identifiable natural person;
• Foundation – entity managing the website: Fundacja Warta Uwagi, ul. Warszawska 70, 26-600 Radom, KRS: 0000979215, NIP: 9462718535.
• Payment Operator – a payment service provider within the meaning of the Polish Payment Services Act of 19 August 2011;
• Privacy Policy – document describing the processing of User personal data;
• Terms – these Terms and Conditions governing the website http://warta.test/;
• Website – the internet service operated by the Foundation at http://warta.test/ or its extensions;
• ICT System – a set of cooperating IT devices and software enabling processing, storage, sending and receiving data via telecommunications networks;
• User – any person using the services of the Website or browsing it.

§ 3. TECHNICAL REQUIREMENTS

1. To use the services, the User must meet minimum technical requirements.
2. Access to the Website requires:
   1. a device with Internet access,
   2. a web browser supporting HTML5, PDF format, and JavaScript.
3. Technical requirements are essential for proper functioning of the Website.
4. Some functionalities may require an active email account.
5. Users should apply appropriate security measures when using the Internet.

§ 4. CONDITIONS OF SERVICE AGREEMENT

1. The service agreement is concluded when the User accepts the Terms.
2. Use of the Website constitutes acceptance of the Terms.
3. The agreement is terminated upon cessation of use or leaving the Website.

§ 5. SUPPORT FOR THE FOUNDATION

1. Users may support the Foundation via bank transfer or Payment Operator tools.
2. Payment Operator services are external and independent.
3. The User accepts the Operator’s Terms when making a payment.
4. The Foundation is not responsible for Payment Operator services.

§ 6. USER RESPONSIBILITY

1. Users must use the Website lawfully and ethically.
2. Users must respect intellectual property rights.
3. Content may not be used for commercial purposes without consent.
4. Any interference with the Website is prohibited.
5. Unauthorized modification of software is prohibited.
6. Users must not upload unlawful content (e.g. spam, illegal material).

§ 7. PERSONAL DATA

Personal data processing rules are described in the Privacy Policy.

§ 8. COMPLAINTS

1. Complaints may be submitted via email to kontakt@wartauwagi.pl.
2. Complaints must include contact details and description of the issue.
3. Complaints are processed within 14 days.
4. Incomplete complaints may be left without consideration.

§ 9. CHANGES TO THE TERMS

1. The Foundation may modify the Terms due to legal, technical or organizational changes.
2. Users are informed about changes via the Website.
3. Changes take effect upon publication.

§ 10. FINAL PROVISIONS

1. The Terms are effective from 20.07.2023.
2. Polish law applies.
3. If any provision is invalid, the remaining provisions remain valid.
